We are a small scale industry in Haryana registered in MSME having a manufacturing facility of 10 staff in production and 10-15 worker by Contractual Manpower.
Our Manufacturing setup is at 3000 Sq Ft of area of rented property without having Hydrant system
while we took we did not bother to see that Premises should have hydrant system but Fire officer that for having NOC we should have hydrant system.
now my query is :
a)Is it mandatory to have a factory licence? (Because it requires FIRE Noc and property is rented one and Hydrant system cost id around 3-4 Lac)
b)If required and we dont take Factory licence what will be legal implication on the owner of factory.

As per the act the definition is as follows:
i) whereon ten or more workers are working or were working on any day of the preceding twelve months, and in any part of which a manufacturing process is being carried on with the aid of power, or is ordinarily so carried on, or
(ii) whereon twenty or more workers are working or were working on any day of the preceding twelve months, and in any part of which a manufacturing process is being carried on without the aid of power, or is ordinarily so carried on-
As you have more than 20 employees on roll you should take a licence under Factories Act.
