I am working in a BPO in a traveling process. I compelted my IATA certification last month and because of that I got a good job opportunity. I told my manager that I have to resign now and they offered me to move in sales department where I can get a good opportunity to earn. I trusted them and missed the other opportunity. Its been almost 2 months now but still my movement to sales department is on hold. I have been talking to my higher authorities in my company but not getting any positive response and more over been insulted by top officials. They have made me feel like a beggar. I have been feeling really help less. Is their any provisions in Indian law who protect the interest of the employees from such exploitation.

I am surprised with your IATA certification what good you could have earned in sales department ???. If you ask me, I guess you are to be blamed for the wrong decision that you took to continue with this BPO with your own interest and understanding. I feel you should not blame anyone for that.
Opportunity knocks once and our smartness is to grab it at the right moment, and I guess you have missed that one earlier. Nevertheless, instead of wasting your time on "discussing Indian Law on how to Axe your bosses/company", try approach the company that offer your the Job you missed or start afresh searching for new job.
On lesser count, I feel there is no Law in India that would support your case.

1) From how many years/month/days you are working with your present employer?
2) What do you think the "Sales jobs" are?
3) In which area of function your job/ responsibilities comes and what is your designation there with your present employer (BPO)
4) What do you think the differences between your present job responsibilities and sales departmental jobs are?
5) You were wishing to resign but changed your mind on the basis of verbal promises by your seniors to transfer you into the sales department, does this really make you feel good /satisfied or was this offer better than the opportunity you found based on your IATA Certification.
6) What do you mean by Exploitation?
7) Also request you to explain "insulted by top officials" and "They have made me feel like a beggar"

Exploitation means what they (the management) offered to hold up the employee. Mr sood also stayed with out proper confirmation letter. So, the best way is to go out and find another job.

i have read your post with interest and i agree with your allegations.
Private sector in India, especially the small companies, are yet to understand the employer-employee relationship. They indulge in flagrant violation of the employment laws; and treat their employees in a master-slave/servant relationship.
They have scant regards for human right or human dignity.
This is the mind-set that we have to change. One way is to let the market forces correct this. However in the skewed demand-supply situation this does not seem feasible.
Another way is to strengthen the Laws and regulations and strict compliancee with laws. Also, to promote professionalism in HR who should be empowered and made responsible for issues related to employees and working conditions. There is no certification or a statutory body for HR professionals, unlike one has for doctors, lawyers, CA & ICWA's. The only ones we have are those related to working in Factories and Mines. Any other legislations that exists do not touch upon a large majority of employees or issues.
Your case is an example; where there are no laws governing your situation.
Thus the employer has an absolute latitude to deal as he pleases fit without any worries except for social or professional ostracison, if any.
Time has come to go beyond these; and to have standard terms and conditions covering every human aspect of industries and businesses. At CiteHR we are endeavouring to network with HR professionals and to create momentum to bring about such desired change and developments.

I am working in a company from last 4 months handling pan India operation, I am on leave for 10 days, while on leave I got a registered post of transfer to Tamil naidu, No discussion happened relating to any thing like this, off records HR said you should resign as your relation with your boss in not working so we will go with her only, so please suggest under which law I can get protected or I have to resign. They are now sending reminders to join at Tamil naidu. Also they made wrong allegations which they got aware of and now they are saying we just are transferring you under pour process. Kindly advice me please.
