hi everyone. Am priya, working as an HR-Executive in a manufacturing company. am working in this company since 1 year. no policies are followed in this company. i came to know this after joining the company but it was my first job that too in hr. so i have compromised myself. Company deducts PF and TDS from CTC but do not pay in actual. we show this deductions in payslip and there is no proof for that like pf number, form 16 etc. i was asked to hire people from same industry top companies. i was successful in that. i tried a lot to generate profits first and later convince by boss to follow all policies. but due to past mistakes done by the company,new joinees getting negative feedback from the market and thus some of them quit. and for remaining also my employer is not ready to pay travelling expenses and salaries for sales people till they show results. our products are new but the prices are almost equal to top brands. for this reason sales people are not able to show results in the first month itself. but my boss will not give time more than a month. he will ask me to terminate the employees. even if i try to convince he will not listen to me. Sales employees who have not even received their joining expenses (they come from other states) are not ready to believe the company and continue to the work after 1 month. in this situation i dont see any growth for me in this company. all these 1 year i tried my level best to set up the things but nothing is successful as ultimate decision has to be taken by my boss. now i decided to quit the company. i did not receive last 2 months salary. i have resigned two months back and mentioned 3 months notice period for which my boss did not accept my resignation. if 3 more days passes, i need to get 3 months salary from the company. in this time, if i quit, will i able to get my last 3 months salary if i approach labour office. what is the way for me to get my pf and pli (Performance linked incentive) which is 10% of my ctc. also i dont know how to approach new job with this experience as i didnt get salary from last 2 months due to financial crisis of the company. so i cannot show my bank statement for salary proof. i request all seniors to suggest me what to be done further???? waiting for your valuable replies

Hi,
please take your payslips, if they have mentioned PF deductions on your salary slip, please file RTI to the Epfo office and ask them details of your A/c, if you will get details then you can go to Regional Commissioner of EPFO office. if your PF is not deducted and simply they shown on salary slip then you can file case againest them.
About your job change you try some other companies, companies will not consider your PF, ESI deductions, only they consider how much you are knowledgeable and you are talented in your work.

Dear Seniors,

i have already shown lot of patience that is how i survived here for 1 year. but now i completely feel negative to hire people only to terminate them after 1 month. there is no use for my hard work. am hiring sales professionals from top companies but everything goes in vain after a month of their joining.

I have payslips which is prepared by myself. but i know there is no any account of pf on my name. not only for me but for any employees in the company. deductions for pf and tds is shown in the payslip. and i know its hard to get relieving certificates from by boss as he does not want me to resign the job as am the only HR in the company.

i am the only one who has to deal with all employee queries where i do not have answer for their questions as company is not following policies. my boss word is we will pay only to those who do business (sales) in their territories. but employees(new) word is as ours is a new product with high prices it takes some time like at least 2-3 months to start the business. and my boss is not ready to give them that time and salary.

In addition to their problems my salary is also not in time. am always trying to improve the situation but in vain at end. at last i came to a decision to quit. but my 3 months salary is due with the company. here i ask u is

1. if i resign now , can i get my relieving letters and last 3 months salary, pf amount if i contact labour office. if yes, what is the procedure

2. without bank statement , only payslip that too prepared by me will serve as a proof of my salary?

3. if my future employer asks for the reason for leaving the company, can i say the truth? if no, what can be told

4. is my decision of quitting is correct or i should re think about it once. because in all my mba hr batch mates am only the one who got job in HR. but in this company. i still dont understand its my luck or unluck .

Ans: If you resign you get relieving letter and 3 months salary without fail.

2. without bank statement , only payslip that too prepared by me will serve as a proof of my salary?

Ans: Now a days, the recruiters are seeing pay slip only. For senior positions only they prefer to see

bank account statement.

3. if my future employer asks for the reason for leaving the company, can i say the truth? if no, what can be told

Ans: Yes, you can tell truth instead of hiding the facts. Simply you can say for betterment only.

4. is my decision of quitting is correct or i should re think about it once. because in all my mba hr batch mates am only the one who got job in HR. but in this company. i still dont understand its my luck or unluck .

Ans: Not correct. Because the situation of present industries are in very bad. As a fresher, you get knowledge on work and apply for some other companies, if you are not happy in the existing.

can you please suggest me what i can do for the improvement of the company as an HR and to change my boss mindset of not following policies...any tactics from your experience. As it is my first job and first company, am very much attached with the company and wanna do something good for it before leaving.
