Hi All, I have given three Work Orders to a contractor to carry out three types of work inside my plant premises in Odisha. He will engage more than 450 workers (around 150 each in every contract). The nature of the job is different for all contracts. Does the contractor need to take more than one license?

Since the contractor is one, he needs to get only one license. The License must, however, should show all the 3 types of work done in the license

Your company has given three different types of contracts to one contractor, and your query has been rightly addressed by our colleague Saswata Bannerjee that the contractor needs to have only one license. You have, however not disclosed as to the nature of contracts i.e. construction oriented contracts of civil, electrical, mechanical, services, purchases etc. etc.

2. It is expected that you have entered into three separate and specific contracts and also got executed relevant type of contract agreements with detailed terms and conditions. It is essential that your contract conditions enjoin upon the contractor to deploy qualified and experienced engineers to execute the site work. It is also essential that the contractor has got registration under specific laws related to the nature of activity of the contract. And further the contractor has obtained comprehensive insurance policy including the third party insurance covering all types of industry specific contingencies.

3. It is hoped that terms and conditions related to payment, retention money, security deposit, performance guarantee etc are well defined in your contracts.

4. It is also advisable that you ensure that proper site records are maintained by your Engineer Incharge as well as by the Engineer Incharge of the contractor because these
records will be essentially required to decide the future issues of delay in completion of project, defects in work and levy of penalties/liquidated damages etc as per T&C of contract agreements.
