First of all you should ensure that you are eligible for higher pension. The basic conditions are:
1. You should be in service as on 1st September 2014 and not joined later on.
2. Your employer should have contributed to PF on salary above Rs 15000.
3. That higher contribution is still continuing even today or if if retired after 1st September 2014, till that retirement.
You you satisfy the above conditions, you can submit option through online portal. But the online portal is not working as of now. In such circumstance, you can give joint option, a declaration signed by you and your employer that both of you have been contributing or have contributed to PF on higher salary and, if still in service, will continue to contribute on higher salary, with proof of such contributions, offline.
The EPFO persons may refuse to accept it but you should insist them to accept it. I have experienced the same in one of the offices in Kerala when I approached them with a joint options of some fifty employees. They refused to accept it but when I said that I am representing about fifty employees and if you refuse to accept it, all the 50 persons will rush to this office and that would create even a law and order situation, they accepted it. Even we have a court verdict saying that in the absence of online link, the EPFO should accept the offline joint declaration/ option.
