Hi Everyone...
Can anyone please let me know what should we do when one of the candidates resign from the company and if that candidate join our competitor's company with th e same job profile and with the same product.even if it is already mentioned in the appointment letter that when the candidates resigns from the company he /she is not allowed to join the competitors company or he can not work with the same product and same job profile for the next 5 years else legal act will apply accordingly...
The same has happended with my company...
Kindly let me know wt type of action shoul we take for the same so that tht person can learn something...also many of our orders for the same product has been now transformed to their company coz of which we have to suffer from this condition...
Kindly request all of you to suggust something

Hi Yogita,
See when person is got some experience and definitely he has to go for a change with same experience only.
why he has to go for different, when he is not having any exp in related areas.
you can take action, only when he has taken any data of your company.
other than that who r u to tell ,that he should not join your competitors company. just find out the reasons y he left the organization and better to see that no one will move out of your company.
as u said, u mentioned everything in the appointment letter.
will u give job if we dont have any experience in related field.
try to think liberally.

Dear Y,
I am not agree with Ashok's view. Every Company has its own Policies and every one has to follow. It has some meaning.
Oeky.
Have you made a bond withe employee?
have you take acknowledgment on O/C of appointment Letter? with Read and accepted Toto.
Go with Legal Department and issue him / her show cause notice for violation of rules and regulations of your company.

Hi...
Ya ofcourse he has signed the appointment letter only after reading all the details for the same and even how can i come to know whether he has taken any data from PC...bcoz nw the world has changed and also technology has increased day by day.....how can i come to know whether he has taken any data in his pen drive or not.....
Kindly suggest for the same.

1. I agree with ASHOKs views and even I am of the viewpoint.

2. Dear Yogita as far as taking data is concerned, even if he takes data you cant do anything he must be having all his own contacts in the industry and for the competitor he is doing the same which he did for you and just because your competitor succeeded in satisfying his need he joined the competitors company. And there is nothing wrong in it. Tomorrow there is not a guarantee that you will join any other company and take the data of ur present companys work in pen drive and copy paste the policies in other company, even I TELL BOLDLY THAT EVEN I DO COPY DATA FROM MY OLD COMPANY AND USE IT IN MY NEW COMPANY ,ALL DO IT AND NO HR CAN DO ANYTHING COZ ITS IMPOSSIBLE TO HAV SUCH STRICT POLICIES< AS IM WORKING I NEED PEN DRIVE AND DAILY LITTLE LITTLE I WILL COLLECT DATA AND SIMULTANEOUSLY CREATE MY OWN DATABASE PARALELLY AT MY HOME PC SO THAT WHENEVER I LEAVE I CAN HAVE SAME DATA, THIS IS WHAT I DO, AND YOGITA DONT WASTE YOUR TIME,,

AND U THINK ANY COMPANY WILL TAKE PERSON WHO WORKED IN OTHER FIELD PRODUCT N GIVE HIM TRAINING, NOPE DEAR, APPT LETTERS ,, ARE JUST FOR WRITING BUT REAL LIFE IS DIFFERENT DEAR

this is India.
Rules and regulations wont work in our country.
do u think that he will be punished?
ok any how its up to u and your company.
but don't waste time with unnecessary things.
If u give complaint wat will happen? You have to roam with court and police stations.
Any how it will take so much time. its not so easy as words.

And Yogitha, remember one thing, when he was joining into your company also he might have used old company data base.
See here as ravi said all letters for just proof thats it.
It wont work in real life

Dear Yogitha,
As Ravi and Ashok mentioned, documents will not support you to catch this guy and punish him.
In this cut throat competition, meaning of success and ethics have changed over a period of time. No one can stop anyone by sharing his/her knowledge with the new employer.
As far as data transfer and copying is concerned, what you can do is,
  1. sit with your system support or system admin guys and ask them to track official mails of employees and keep a copy in mail server
  2. Ask them to remove CD, Floppy and USB drives from all the systems available in office except the key ones which MGMT or higher officials use.

well dear friend your point no 1 is valid but your point no. 2 is not true, coz if u implement the CD, floppy, n USB drives only for mgmt and higher officer people, then in case of urgencies or when network doesnt work or even executives work at home, then they will cooly blame the HR and tell,,
HR ne humko pen drive, cd ki facility nahi diya hain, to hum kaam kaise kar sakte,
and HR will become bali ka bakra, writing is easy try implementing in REAL,
and to be true, even i have been to many companies where only IN BOLD LETTERS its written outside NO PEN DRIVES, STORAGE MEDIA ALLOWED, but the security dont even care to ask me, about it,,, and even if they ask I tell no and make my way inside and easily i can steal any data from help of any employee,, hehehe
this is india,, dude a lot to improve on our securtiy and systems..
