Dear All,

In Tirupur garment sector, most of the factories work 8 hours plus another 1 to 2 hours over time work on daily basis based on their requirements. This extra work is paid at premium rate too. The regular work hours is normally from 9.0 am to 5.30pm.

In few cases, workers report at work at 11.0am work 6 hours a day and then after 5.30 pm they work 2 hours till 7.30pm. Here the worker is not completed 8 hours of regular work. Any work more than 8 hours is considered as over time work and in this case, since the worker is not completed 8 hours work the question of premium rate is not raised. Right..?

My query is in this case, do we need to pay over time wages at premium rate for this extra work or regular pay for 8 hours is enough for the work he/she rendered from 11.0am to 7.30pm..?

Kindly advise.

Dear Rameshan,
If you look this on statutory ground then you need not to pay any overtime, but if you have asked them to work for 6 hours and they have put in their extra hours of 2 hours then ethically you should pay them overtime. As this is more to do with commitment rather than statutory norms.

It is good to note that it is legally right to state that this 6+2 hours is not over time work.
But I do not understand how this question of ethics is coming in...?
He/She do not do any work in more than 8 hours and hence no question of legal or morale liability to pay double the rate of wages..
