Hi,
I am in USA with H1, My wife was working india ,i came hare 7 months back, she joined me here 1 month back, she came to USA on vacation for 2 months as my assignment is short term, we thought of going back and continuing our jobs but my assignment is changed to long term, so it is not possible to stay away for long term with my wife, she has bond in india for the current company for 3 years and 2 Lack rupees, she completed 2 years till now, she can not go back and complete 1 year, is there any chance of resigning from here, or is it best to go back and resign and pay ( which is very big amount for me)? or abscond what happens if she abscond, can some one guide me plz which is very imp for her career.

The case you presented is very human. Please check the document , your spouse signed. Mostly the amount is based on a fixed duration, within the lock-in period. This entails that 2 lacs were to be paid with a fixed period , beyond which its only about the remaining amount. If this is so, the amount, what she might need to pay, is far lower.

Ask her to begin discussions with her reporting head, requesting for a sabbatical. If she can take a break for an year and then join the firm back , it can save her, every hassle. If it requires her, she can enroll for any education within this period, to support her case.

Try and nudge to save the job, at the most request for a release on an humanitarian ground. Ideally, the bond is designed to keep the talent productive on the role. However, if the talent is absent or cannot deliver , it doesn't serve any good. In your case, staying in different countries, for prolong duration only to attend to the duties, isn't too human. Avoid absconding at every cost.

I am certain you will find the best measure. I wish her all the very best!

Thanks for the response, As per our knowledge they will not provide sabbatical for 1 year, and bond is for 3 years with with no deduction based on time served, Coming to humanitarian ground they have Big ZERO values, for the vacation only we tried very hard, now we are worrying as why we joined such company, and not understanding how to protect career and stay together... as we have Pay slips and Bank statements is it works to show Experience? will Abscond will works for us? please guide us.

Looks like you 'seem to have made up your mind' to 'abscond'.
Like (Cite Contribution) mentioned, DESIST the urge to abscond. If you are trying to solve this problem thru this approach, pl note that you are about to create another--FAR LARGER--problem. Since she is also in the IT industry, she is bound to have tough time during her BC when that time comes--especially since this will be her 'most-recent' job when she begins to look for another job later on--and I am discounting the option of faking the resume in order NOT to show this exp at all for more reasons than one.
Though it's a tough call for you, the only option your wife seems to be having is to pay-up & get relieved the proper way--AND learn the lesson.

I second Sateesh . Please put request on the humanitarian ground, in writing, offering every options to the company for release. Mention every process towards the release, in spite of how they treat . Keeping communications courteous and to the point, will not allow them to mess too much. We are certain she will find the best way out !

Hello,
Shun the thought of breaking the bond in any form!
Be amenable to the terms you have signed voluntarily and kindly find no excuses to behave differently!
For a little selfish interest, it is unwise to sacrifice one's honour!
Having said that, please also consider consequences of being blacklisted. The future could be affected and it will take a long time to reconstruct future!
Please do NOT succumb to the temptation of "absconding"! Whether there are "consequences" or NOT, it is WRONG to do so and for that reason alone, one should not entertainment even the thought!
Ultimately it will be your decision!
