Hi, One of my friend gave resignation and he was on probation at that time. company did not accepted his resignation so he serve 28 days instead of notice period of one month. He asked to HR to accept his resignation mail but they denied to do so, after that he took exit from there, now they refused to transact his salary. Is there any rule to make his payment?

Hi,
Notice period time frame depends on the terms and conditions of the Appointment order issued to your friend.
Instead of 30 days your friend had completed 28 days notice. In all fairness the employer should pay the full and final settlement after adjusting 2 days shortfall. Employer has no right to hold salary.
Your friend can follow up for salary through email RPAD letter in case of no response from your employer advise your friend to contact Labour officer of the respective juridiction who can intervene for solution.
