YES. It is applicable.
Hope you might have obtained the approval for construction of the factory from the Inspector of Factories. After approval you can start construction of your factory. Once the Manufacturing process is commenced, then automatically the BOCW Act applicability will be ceased and the Factories Act will be applied.

The Act is applicable toall establishment which employs 10 or more in building or other construction works.Managerial&supervisory person with salary above Rs1600/pm are excluded.It provides for health,safety ,welfare etc of workers like Factories Act.

You have to contact with local labour deparment where you can get form for registration if you have awarded construction contract to someone else. 1% of the total cost as labour cess will be deposited by you with the BOCW department. Thanks.

Is BOCW CESS applicable for Construction activities inside the Plant Premises of Operation Power Plant Units ?
Since the Plant is operational and fall under the Provision of Factory Act, 1948; therefore BOCW CESS for Construction inside the Plant Premises can be excluded as per the definition stated in Section 2(d)
