One of our worker is having birth year of 1963 in ESIC card. Whereas on the Adhaar card the year of birth is 1960. For retirement which card is to be considered. Kind regards Deepak

Thanks Mr. Srinath Sai Ram for your response. He had joined us in 2001 after working for some other company. We had taken the same age 1963 as was indicated in the ESIC card, hence our company record shows DOB as 1963. As on now due to the linking of Aadhaar with PF etc this discrepancy has come because Aadhaar shows DOB as 1963. I hope I am able to explain.

Dear DEEPAK, What is the Document on which Appointment was made? ESI Records are filled by the Employer? Aadhaar is Proof for identity What is the Date of Birth as per your Company Records?

Hi Deepak,
The ESIC card is not a proof of DOB at all. Your company must have referred to any identity proof in the past at the hiring time. Nevertheless now if the Aadhar card is saying a different DOB then you need to consider this and make correction everywhere else.

Please call for Employee records & verify thoroughly.Due diligence has not been done at the time of Joining your Establishment.Please put proper systems in place to avoid recurrence of such things in future.Please do not rely on ESI CARD, AADHAAR for determining Date of Birth

Dear Mr Deepak, Date of birth can change in documents , ask him to rectify, even in Aadhaar card also.

Hello Deepak, As regards determining date of birth, the provision in the Standing Orders applicable to you offers the decisive test. Normally it is the school leaving certificate. But if he is illiterate, what was the date he declared at the time of joining.You had mentioned 1960 was in the ESI Card of previous employer, but did he mention so in his application for employment. Then it can be relied. Otherwise ESI Card, Adhar Card are not verified documents for age. The certificate of municipal/panchayat authorities can also be relied.

Dear Deepak,
Ask the workmen to get an affidavit for his DOB. Thereafter the DOB appear in Affidavit to be incorporate in ESIC & EPF. Then the workmen to apply for the ammendment of DOB in Adhar. If he does not do that he has to face a lot of trouble in future, as Adhar would be based for everything.
