Dear Forum Members,

If an employee was absent without leave for three consecutive work days (Monday, Tuesday, and Wednesday) and returned to work on Friday, is he eligible for Sunday as a weekly off ? or does the employee need to work a minimum of 3 days to earn it?

There is no rule that a weekly off days should be paid day. But when you have a month comprising of 30/ 31 as the walary period, the weekly off day is included in it. At the same time, in respect of workers who are paid per day of work, he will earn only for the days he works. Naturally, the weekly off day will not be paid day. In such cases, his daily average wages should be one which is derived by dividing the monthly wages by 26 and not 30. The law only says that after a continuous work of six days, an employee should be given 24 hours rest. If he is absent from Monday to Wednesday or Thursday, he will not qualify for weekly day of rest also. That means after a four days' absence if he returns on Friday, he need not be given Sunday off. But if he is coming to the office on Sunday which is off day for others, will you pay him? What value he will add by working on Sunday?
