Normally, procedure for termination on the basis of poor performance is an integral part of the overall HR Manual.
Does your Company have one? If not, you must get it made. Once you establish a procedure and follow the same, you can terminate the employee.

Dear,
Termination with-out any procedure or taking care of legalilty is giving invitation to trouble.
If you have laid down procedures, follow the same, the termination of the serives is last resort and you have do complete the paper work before termination showing various aspect ofnon-performance if any time to be shown as back-up in legal case.
The best way is to ask employee to resign with sharing in respect to non-performance.
When employee is on authorised leave, it is unethical to send dismissal papers, company will have tough time to explain its process of dismissal.
