Hi Team, We are an Edtech and IT services company based in Mumbai. We have 50+ employees. Our work days are 5 days a week. Earlier, all employees were given 24 CEL and 14 festival-paid leaves. Now, management has cut down the CEL to 12 and 10 festival leaves; no other leaves are given, such as CL, SL, or PL.

I want clarity on what the leave policy should be for the company. Please Guide.

Dear member,

Provisions of the Bombay Shops and Establishment Act apply to your company. So please follow those provisions. The number of days of leave can be more than the provisions of the said act but not the less.

As per your posting, it is roughly understood that the company has changed the "service conditions". The chang in service conditions amounts to violation.
You and affected employees are hereby advised to bring this to the notice of labour department of your area, and also take the advice of the lawyers too. Because, it is difficult to guide you on the basis of two line sentences.

Please check Maharashtra Shops and Establishment Act.

CL / National & Festival Holiday provided by your Employer is well within the Act.

There is no provision for sick leave as per Maharashtra Shops and Establishment Act. But Earned leave ( or PL) is applicable.
