Hi Vineet, clarify what it mean by Specific area? You mean to say above 15,000 gross salary?

Dear Vrushali,
Specific area means area in which ESIC is not applicable. It does not means exempted employee. Some area or district are exempted from ESIC beacuse they not cover in that Municipal area in which ESIC is applicable.

But I am having one more point in the same discussion.Few days before I read as per new amendment Workers compensation act renamed as Employee compensation act . And the criteria of benefit has been changed.
So make it confirm...

if ESIC is not available in a specific state (like in Sikkim) , then what Act will be applicable for workers working in Sikkim and and request you to provide details on where to approach and applicable charges etc. please.

Dear Deshmukh,
I would like to give the information, first you have to approach the ESI Officials regarding coverage of ESI in your business premises because all business units with in 15KM of the ESI Dispencry only ESI Act coverage - Act said like that. some time ESI Official coverage some areas on special conditions.
after conformation of ESI Officials, if it is not coverage under ESI Act then you have go for Workmen Compensation Policy issued by any general insurance company under Employees Compensation Act, 1923 ( early called as Workmen Compensation Act, 1923)
This is my knowledge and experience.

Hi,
Employees compensation act is applicable and common .However Esic Act provides for any other insurance schemes to be availed provided the schemes assures the better benifits than Esic.For This Esic grants exemptions too.

Hi Vineeth,
Ep you can go for Work Man Compensation, However as it wont act like ESI and as its not so liberal in treatment you can also tie up with any hospital too for first aid treatment.

Dear Friends,
Only in case of employment injuries the workman compensation act applies whereever the ESI scheme is not covered. But, in respect of usual medical benefits to employees, it is between the Management and union to come under the terms of the wage agreements. Most of the companies pays one month basic wage(Basic+DAs) to its employee as medical benefits.
In many companies, where ESI scheme is implemented, in case employees are out of coverage of ESI scheme as they exceed the ESI ceiling limit of Rs. 15000/-, the Management pays such employees one month's basic+DAs as medical benefits.
