Dear Friend,
The ESIC is applicable if you are doing any addition construction Work in the premises of the factory,if you factory is newly set/ Employee compensation Policy
For New Construction NO ESIC is applicable , but the construction activity carried in a factory, where the workmen woking in the premises of the factory are covered under ESIC then the said construction activity comes under the provision of ESIC Act

I totally agree with you that E S I act is not applicable to Construction Industry, How the compliance is need to be made is it required to take Workmen's Compensation policy from any insurance company.

There is a notification no- 4/99 regarding the coverage of construction agencies/ offices of builders under ESI act, 1948 which mentions that ESI act is not applicable to construction agencies. We engaged an agency for construction work. If act is not applicable to them, then is our factory is liable for ESI?
