Sir, I am working in a mid-sized software company for 15years. I have got an offer from an MNC company.so I served my notice period which ended 2days back but my current company is asking me to stay for 5-6months and not providing me relieving letter. I need to join my new company in 10 days. I requested my current company several times but they are very rude towards me. As I am working in this company for 15 years I don't want to leave without a proper exit. What should I do now?

Quite dismaying to find that after serving for 15 years, you are required to go through the ordeal of an unsmooth separation. It appears that you could not develop proper contacts within the company. Even after serving for one and a half-decade, your relationship remained transactional with them.

Why the authorities are rude to you? Is your separation under normal circumstances or it is under negative connotation? Have you been told to submit the papers?

What about the separation of other employees? Does the company give the same type of treatment to all the exiting employees or you have been treated this way in isolation? If the latter is the case, then it shows that the company was depending on you and possibly they could not arrange a suitable replacement. As the news of your separation has given them a jolt, they are taking your separation to their heart. At present the authorities are reactive.

This is a test of your patience and coolheadedness. Therefore, do not lose your cool. You need to bite the bullet. Approach the MD of your company, and beg for a smooth exit. Let us see whether the MD shows temperateness or remains inclement.

One of the possibilities for demonstrating rude behaviour could be to bring to your knees. They wanted to enjoy their whip as an employer and finally, they wanted to negotiate with you on the disbursement of your last 1-2 months salary. Giving up salary for no fault of yours is a tough call. For the sake of obtaining an unblemished service-cum-employment certificate, whether to swallow the disappointment or not is your call.

My company is dependent on me so they are not providing me releiving letter and asking me to stay for more than 6months.My company notice period is only 30days officially.I have requested my CEO several times but he is not accepting.do we have any problems if we go legal.will MNC companies like TCS, Cognizant agree if I show my salary slips and appointment letter without releiving letter Please suggest.

Hi,

This is really shocking to know such things happens with employees who had such a long journey with one Organisation.

Definitely MNC's will ask for relieving letter from the previous organisations, It's one among the several other documents in their on boarding checklist.

You may request the MNC for delay in submission citing F&F settlements. Because most of the organisations will do their F&F settlements in 30 days and then only they will provide relieving order.

As, Mr.Dinesh said you have to be patient and talk to your MD. You are not alone, many companies treat their employees this way and not allowing them to have smooth exit nor do they think that " Why this employee is leaving me after having worked for so many years?.

Dear Colleague,

It is highly unacceptable act on the side of the organization to treat a person who served for 15 years and when he want to leave, he is facing problems. This might be due to the overdependency on you by some one in your organization. This challenge has to be handled very tactfully and you should come out very peacefully. Have a thought on these lines and generate your way forward:

1. Whether the organization is preparing some one in your place and suddenly they will one day relieve you by that time you would have missed the other offer also. This is being done by many organization and that is the sorry state and truth which is bitter to accept

2. As you need to get your gratuity, PF (transfer) and experience certificate for your 15 long years of service you need to work each day for getting your relieving. Going legal may be a long fight and it will affect getting these benefits and will delay in getting benefits

3. Not only MNCs but many companies will ask for experience certificate and relieving letter as it is a long service.

4. Now it is like a rope walk for you as to convince your present management and the next employer both suitably and on one side keep insist for relieving and gain time for joining to the possible extent from the other employer. Transparently share to the next employer the difficulties in relieving.

5. Use escalation matrix and take up to your Corporate HR as it is truly unfair practice. I use to say " Organizations are great and only few people make it bad by their behaviors"

6. Even if you are given a counter offer and promise for salary hike etc, it is not a good option to accept as normally they will secretly select some one and sack you. Hence say a big no for this.

Handle carefully and escalate all channels and caproate and also do not leave the discussion without getting proper reliving. Rest it is in your hand how you tackle this situation confidently and tactfully. This is a practical view as Legal battle will be cost involved, time consuming and will affect your concentration on career. God Bless!!!

Can a 15years experienced Technical Architect join Cognizant by showing PF and bank statements instead of showing releiving letter because my current company is not giving me releiving letter and asking me to stay for six more months.

Hello,

I faced the same problem in my last company, but I didn’t lose my cool. I had a word with the higher management and convinced them at the end. I was lucky enough to get my relieving letter. So, have patience and keep trying till they agree.

If things do not work out, you will have no other option but to talk to the HR manager of your new company. Tell them your situation and request that they accept any other valid document such as salary slips instead of a relieving letter.

Have you got a resignation acceptance letter? Many good companies issue Resignation acceptance letter, immediately on submitting of resignation letter where in it is clearly mentioned on what date you shall be relieved. Talk to your present employer in these lines. If necessary, take appointment with higher level authority and discuss very patiently and assertively . Try to avoid aggressive talk as this will hamper only your side.

They are asking now that they will give me appraisal and I need to sign 3months notice period which was initially 30days in my appointment letter.i have putdown my papers on Dec 2021 and served my 1month notice period but the company didn't releive me and replied on mail that they will release me on June.I don't have confidence on them that they will releive me .what should I do now
