Hi, I wanted to know details about new maternity policy

Dear Jayesh,

Here are the required details.

As per provisions of the Maternity Benefits Act 1961, a lady employee is entitled to maternity leave on application by the lady employee concerned along with a certificate from a Registered Medical Practitioner.

A lady employee is entitled to maternity leave for a: -

- Maximum of 26 weeks for first 2 children, Maximum of 12 weeks with two or more surviving children

- Maximum of 12 weeks for a commissioning mother (a woman who uses her egg to create an embryo implanted in any other woman) & adopting mother (the age of the adopted child should be less than 3 years). The period of maternity leave will be calculated from the date the child is handed over to the mother. This leave is applicable only for the first two children

- The leave must be availed at a stretch

The other provisions of the Maternity Benefit Act 1961 shall apply, as the case may be.

The following provisions are additionally being made applicable:

A lady employee, after exhausting the eligible maternity leave with full pay under the Maternity Benefits Act, 1961, is being provided with the following options:

• Avail Privilege Leave to her credit with full pay

• In case the PL is exhausted then she can avail extended maternity leave with half pay up to another 12 weeks
