Please Guide me for the following matter. I am working in pharma company as a hr:
1. One of our employee gone for maternity leave and after her six months leave she applied for 2 months extra leave
2. for 2 months extra leave she requested to us to adjust her EL which is having and she worked only jan to april-2018 ( May to Oct-18 ML) & ( Nov to dec -EL).
3. As per act, which i understand -for the next year, means -2019. She will get EL only for presented months to factory that is Jan-April-18 only .
But she asking, she is eligible to which is applied EL for Nov &Dec-2018 for those two months also.
Please suggest me whether she eligible for those two months also to calculate nxt year ELS.

Dear Member, Earned leaves taken by the worker are to counted only for eligibility for next year but these are not to be considered for calculation of EL to be granted in the next year. R N KHOLA

Hi, Complitely agree with u. s. sharma as, EL is "earned" or counted on physical attendance only. As per this law you can denied her request.

if employee resigned and he worked only 20 days balance 10 days he surrendered his ELs, in this case,
1. We need to pay one month full salary or only working days, means 20 days only..
please give me your valuable suggestions.

ML HAS NOT CONSIDERED IN ACTUAL WORKING DAYS SO THAT,S WHY SHE,S NOT ELIGIBLE FOR EL IF SHE WAS PHYSICALY WORKING IN THAT DAYS THEN SHE, ELIGIBLE BUT FOR EL CALCULATION 240 ACTUAL WOKRING DAYS ARE COUMPLOSRY AS PER ACT
