I have joined a Noida Base Company 09th Feb 2015 as Deputy Manager- Finance . The salary offered Rs. 38000 per month. But Salary not paid on Time. I resign 5th Apr 2015 and serve 15 days notice period (as per appointment letter) and handover assignment to Director. but still not paid any salary ie Feb 15, Mar 15. So i request to you pls help for recovery of my salary. How can i recovery my salary from employer. I several SMS to Director for Payment but reply not satisfactory.

I have few question with regard to your query to help me understand the situation before I suggest something.
1) What kind of company is this ? I mean, is it a proprietor based firm or partnership firm ? What's the employee strength & company size in terms of turnover, EBIT ? (Since you are a finance person, you would be able to know it).
2) Do you have an appointment letter duly signed by the company official on the company's letter head ? Does it have any section stating anything about the salary payment (mode of payment, income tax, date of payment, etc ) ?
3) What is the company's history with regard to salary payment to employees ? (for the last 6 month's or more)
4) Is your company registered under Shops & Establishment Act ? (If yes, then you would be able to see the registration certificate hung at the reception)
5) What is the reason that the employer/company has given for not having paid the employees, their salaries ?

Send a written complaint to Inspector under the Shops and establishment Act to get your full and final settlement done.Alternatively send legal notice for payment of dues through civil çourt and filing of criminal case of cheating under section 420 IPC since no salary appears to have been made since the beginning.
