We have not retired a employee on the retirement age of 58 years and retired him at the age after 60 years. when the employee filed his claim for PF and EPS to EPFO than his claim was rejected which read as "Claim rejected. Provide permission letter to contribute EPS after 58 years". Here we would like to declare that no amount was deposited in EPS head after he attained the age of 58 years. The whole amount was deposited in his PF heard only. Please guide us how we may help our Ex-Employee in getting is claim of EPS & PF.

These are new steps that the EPFO is taking just to harass the employees after they had suffered a serious blow from the Supreme Court on higher pension case. Even when there is an official circular that permits employee to continue contribution to Pension Fund even after 58 years of age, why should they take it so seriously when there was no contribution to Pension fund after his actual retirement date?

Anyway you can write to EPFO that the employee concerned has continued in service even after his attaining the age of superannuation as per EPF and MP Act norms and the employer has contributed to his PF till date. There was no need of any permission letter because our company does not have a policy that every employee shall retire on attaining 58 years of age. The employee was not interested to draw his pension on his attaining 58 years of age but decided to defer pension following GSR 440(E) dated 25-04-2016 of the Ministry of Labour and Employment.

I am also attaching a copy of the above said notification.
