Under shop and establishment act of Indian government. what is the clause or rule for calculating earned leaves for an employee. does an employer actually needs to earn such leaves or he gets it directly after completion of 1 year of his/her service.

As the very name suggests an employee has to earn the leave for calculating his entitlement which means the leave will accrue on the basis of the number of dyas actually worked by an employee.For example the Shops Act may say that one day leave for 20 days of working.

Mr.Khola is right, one needs to refer to respective Act as applicable to the sate as the leaves vary.But one needs to earn the leave by putting in service. For example, in Delhi an employee earns 5 days EL after 4 months (with proviso of certain min days of work in these 4 months ) as well as one CL/SL per months.
There is no thumb rule for the EL.
