I have recently joined a good company.But after joining it , i am feeling as if it is not suitable for me.
I have another opportunity elsewhere.
I would like to quit/resign from the current company.It has been only 19 days since i joined this company and have not been assigned/involved in any tasks.
In the contract, it is mentioned that an employee can be terminated by either parties by giving one month notice or one month salary in lieu of notice period.
i would like to resign without notice period from my current company.I would like to know is it possible that the company will make me serve the notice period even if i am not able to serve it and also agree to pay the one month salary to them in lieu of notice period.
I would like to resign and get relieved within a week.Is this possible.?

Hi,
Since you are in probation period and also ready to pay one month salary in lieu of notice period, your present company cannot ask you to serve one month notice. you can very well quit the job immediately, by paying notice period salary.

One cannot escape from the fact that we get to know the inside story only after joining. How can you be sure that the new company will be better? There is also a possibility that since you are not fully engaged, you find yourself getting bored.
As regards resigning, it may be better to leave in an acceptable manner. There are many advantages. Normally during probation there is no notice period. Please recheck. Since you are willing to pay, there should be no issue. But do leave on a good note. It'll stand you in good stead.

some companies do insist on one month notice period even on probation. check your appointment order and go thru the clauses mentioned in it. since you are in probationary period, generally there is no

As mentioned by R Devarajan, there is no legal binding to serve one month notice as you have not completed one month of service so since you have not even earned your first salary they cannot legally bind you to pay for one month.
It is advisable to give sufficient time which you are ready to give and reasonable also to the employer to get a suitable reliever.

I working as Jr.accounts officer in one private ltd company last 1 1/2 years , i got new job in another company . so that i resigned form the company and received offer from the new company. old company asking the Notice period one month but i am not able give notice period to this company , but new company wants to join as soon as possible. if i go for the new company without notice period and no handover in the old company any legal issues can create with me or not. i can go for new not giving notice period .............. pls share the ideas ................
