Hello Gentleman, Recently two of our employees resigned. We have mentioned in their offer letter a bonus of Rs. 583 in their CTC working. They worked only 6 Months. Now they are claiming the bonus amount applicable for 6 Months duration they worked in the organization. We just want to know whether we need to accept their claim or not. My question here is, they have not completed one year, and they resigned only based on their interests; in such a scenario, they are eligible for the Bonus amount.

For bonus, the eligibility is just 30 days working in a financial year. Moreover, the amount of bonus is shown as part of their service condition because the amount is specifically given in the offer letter. Therefore, it shall be paid to them in proportion to the number of months they have worked. If your establishment is a scheduled employment for which minimum wages has been notified by the government, then the amount of bonus should increase because the bonus should be calculated on the basis of minimum wages and not just Rs 7000 in respect of employees whose minimum wages are fixed by the government. therefore, if they dispute over non payment of bonus, they will get more than what you have provided for them.
