The number and eligibility of Earned leave differs from Factories Act and Shops and Establishment Act. But the number of CL, SL and EL are about 40 days in a year.
The Leaves as per Shops and Establishment Act:
The eligibility: Any employee who worked for 240 days.
CL: 12
SL: 12
EL: 18
As per Factories Act:
EL: Section 79 of the Act: Every employee who, physically, worked for 240 days, is eligible for one day Earned Leave for every 20 days of his physical attendance. i.e. 18 days in a year.
For computation, the following days can be taken into consideration, but for computation, these days are to be excluded.
1. Availed Earned Leave during last year.
2. 12 weeks of Maternity Leave.
3. Notified lay off.
Year means calender year.

Can anybody explain about the National holidays/ festival holidays
for leave calculation in Factory act.
ie. if employee comes for 25 DAYS with 1 National Holiday
for Jan Month with 5 weekly off.
then while calculation for leave we have to consider 26 days
or 25 days since the employee physically present for 25 days.
in nut shell : Whether we should consider the holidays (National
& Festival ) for leave calculation.

Please note that listed holiday or national holiday is a part of off given by the co to their employees and can not get clubbed with leaves untill and unless the employee has taken any other leave with it.
Ex - 1) if he was present for 25 days + 1 holiday = 26 days of working.
2) if he/she was on leave day prior and after that holiday then you can club it with his/her leaves.

hey i worked in Moshes. we have our cafes and hotels that co offer only 4 leave for the new joiny than what 2 do..........? Can we raise the question against this.

My company provided 36 leave as AL-15 SL-6 CL-6 and 9+ 3 public holiday. Is this right or not and which leave we will carry forward for next year and how I calculate leave
