I would like to know whether in India we have any list for unethical questions which should not be asked at the time of interview? I am an HR professional with experience in MNC's and software companies. At the time of HR interview my seniors used to ask question regarding the female candidates marital status ,if not married, when is she planning to marry?,Why she is not married yet? If married, Is she planning to have a kid ? . I was not comfortable with these questions. Sometimes they reject talented female candidates citing the reasons like she is in marriageable age or she is just married or she have a small kid. As a woman I am against this kind of disparity. Kindly let me know whether we have any rules pertaining tothis issue. I am aware that an employee in registeres company cannot be terminated if she is pregnant , but Is there any rule to avoid inequality at the recruitment.

You have raised a very pertinent question. To my knowledge, there are no such guide lines or instructions, with regard to DO's and Don''s The main reason one asks these questions, is to be assured of long term continuity and commitment to work. The employers are normally apprehensive about regularity in attendance, time keeping, separation from family if the husband is employed else where etc. In our Indian setting, it is known that besides, her professional work, a lady is supposed to be a home-maker with multiple responsibilities.
However, these should not be the reasons to reject a competent candidate.

If there are no guidelines or instructions then it is really hard to control this kind of inequality. I understand that the HR representative asks these questions to assure stability., but the prejuduced attitude may hinder genuine candidate's career.

This is an issue like a pest in all organisation, not only sometimes an worth employee failed to be selected also the female employees suddenly find themselves demotivated by the nature of recruitment...
The main reason every time the authorities site is : 1) Continuity of service will get disturbed
2) a woman employee at the marriageable age cannot be trusted as she may leave at any time after marriage
3) a woman employee cannot be given hard works because of child issues that have to be countered at home and work place
4) Some of the woman employee may not get proper support from the husband side this is a peril in their life and work management
5) Even though maternity leave is admissible in reality how many indian companies/organisations implement the rules and regulations properly, always, loop holes and burden to the woman employees
6) The cultural bias exist it is an undeniable fact

The fact that a girl candidate has been called for interview, shows that the employer is interested in having a fair selection and is interested in selecting a competent person. However in some cases, I agree, that a girl candidate has the handicap of not being considered due to gender bias.
