I have query regarding Basic wages. If we are paying basic less than minimum wages but over all salary is more than as per Minimum wages act. Is any legal complication is there.

BASIC WAGES AS PER MINIMUM WAGES ARE FIXED ON ZONE AND INDUSTRY CLASSIFICATION FOR UNSKILLED, SEMISKILLED, SKILLED AND HIGHLY SKILLED WORKERS.
IN ADDITION TO THIS THERE IS SPECIAL ALLOWANCE CALLED VARIABLE DEARNESS ALLOWANCE FOR COST OF LIVING INDEX REVISED FROM TIME TO TIME.
YOU HAVE TO ENSURE THAT SALARY BREAK-UP NOMENCLATURE SHOULD NOT VIOLATE THE MINIMUM WAGES ACT OBJECTIVES. BASIC WAGES ARE BASIC WAGES YOU CANNOT BREAK THEM INTO ALLOWANCES...
ALTHOUGH FINAL PAYMENT OF WAGES SHALL NOT BE LESS THAN THE MINIMUM WAGES PRESCRIBED DOESNOT VIOLATE MINIMUM WAGES IN RPINCIPLE...BUT YOU MUST AVOID INTERPRETATION ON RECORD IF YOU PAY ABOVE MINIMUM WAGES..THERE IS ALWAYS SCOPE FOR WRONG INTERPRETATION WHICH IS ALWAYS DEBATABLE.
