I am Sandeep working with one of the call center in Kolkata. I was recruited in this company on 06th Aug 2014 as a Process Trainer. I trained three batches who all went live into the operation floor successfully. In my fourth batch the head count was of almost ten and due to some process problems from the employer end the training went for more than a month. However finally all were release to operation floor. On 19th Aug 2014 our company Ops Manager terminated one my ex-trainees who was in ops now based on the way he spoke to the TL ( pls note this TL abuses his agent on floor) On last saturday i.e 27th Sep 2014, the ops manager terminated two of my ex-trainees as they were not regular to office. The same day one of my ex-trainees again who was live on ops floor went to the ops manager and told he wants to resign as he dont like the floor environment full of abusive language and he left. The same day one more of my ex-trainee live on ops left the company without informing.

To this my ops manager spoke to me and as per her talks it was relevant that she is blaming me to influence them to leave the company. I tried explaining her that why should I do this when I am still working with this company and moreover they are not my trainees anymore, they are into operations and officially I dont know anything. But she put a deaf ear to this. She then said she wants to terminate me, when I said terminate on the grounds of influencing people to leave, then she got apprehensive and then said as the company dont have any new training batch thats why they dont need me anymore.

I just want to know how I can get the maximum compensation from them on this entire ground. If required I can get my ex-trainees as a witness if required. I want them to pay me my maximum amount and also make it a point that they dont play with anyone career like this.

Hi,
1. Organization may terminate employee in probation period due to poor performance.
2. Please check with appointment letter written clause carefully.
3. you will not receive any compensation except your balance salary.
4. If you are confirmed employee then organization should follow termination policy.

Hello As per their Termination clause its written that they will not even let me know the reason of Termination.

Hi,
1.If they have mentioned some kind clause then that not acceptable.
2.Employment standing orders Rule 13(1) clearly sates about Termination of employment.(applicable in case more than 100 employees in organization)
For terminating employment of a permanent workmen, notice in writing shall be given either by the employer or the workmen - one month’s notice in the case of monthly-rated workmen and two weeks’ notice in the case of other workmen: one month’s or two week’s pay, as the case may be, may be paid in
lieu of notice.

Request you to kindly see my original thread. That exactly what happened. They assume that I influenced my previous trainees to leave the company and while one fine day I was training my new batch, this Ops Manger called me and asked me why and all and then finally she says I am being terminated.
I also received an email from the company stating that as per their offer letter clause company is not liable to disclose the reason of termination if in case they terminate anyone.
Its been 45 days I was working with this company.
I sent them few emails stating to send me my release or termination letter mentioning the reason for it but their is no reply from them.
This is a small company with less than 100 employees.
Kindly suggest what I can do in such cases. Their are few of my trainees who were also terminated without reason and company says they wont pay any salary to them.

Hi,
1. you have just completed 45 days means still may you in probation period.
2. if you are in probation period then you not have any right to ask any type of compensation to the employer.
3. Better you just comeout in smooth way.
4. You should have the right to ask your salary.
