Sir,

My father retired from service on 31 Dec 1996. The provident fund was deducted from his salary. He is not receiving a pension as per the scheme of 1995. Is he eligible for a pension as per the latest Supreme Court decision? If so, what are the documents required to be furnished?

Thank you, P.L. Gade

If your father had 10 years of membership in the PF, he will receive a pension. Since he retired in 1996, the benefit of the Pension Scheme, 1996 will be very low, but he will receive the past service benefit. You can approach the PF office with details regarding his membership, etc.

The benefit of the recent Supreme Court ruling is available only to those whose PF contributions were not restricted to 12% of 6500. If your father's employer was contributing their share of the contribution on a salary above 6500, then he may be eligible for the benefit.

When you find this kind of non-payment of PF cases, it is better to raise a grievance at the PF portal. For remaining EPF members, they can claim PF amount online or offline by submitting PF claim forms.
