For IT company Shops and Establishment Act is applicable .For Factory, Factory Act is applicable.
Leave is always a critical issue.
Company can not refuse maternity leave if the employee belongs to the organisation before conveive . The day employee conceive it is the duty of the Employer to treat the employee on humanitarian way.

An employee who has 2 years with the organisation can avail 12 weeks of Maternity leave for her 1st child. In case of illness or complications arising out of pregnancy the employee is entitled to a amaximum of one month leave over and above the 12 weeks of matenity leave on producing required Medical Certificate. In case of delivery of the 2nd child , the employee can aavail 12 weeks of maternity leave but it will be treated as "Leave without Pay'

1) You can arrange for a madicalim and group accedent insurance policy for your employees.
2) You can think about ESI and PF after growing to 20 employees, because it is not manditary for 12 employees and your top management will not agree for it too.
3) Other benefits like safety and health measures are manditary for any organization.
4) Personally I suggest you one thing. Try to avoide discussing about these matters with other employees. It may some times reach the ear of the top management and will affect your career growth.
5) That too when you are working in a startup, you should be very carefull, honest and give your best to learn many good things in the industry. Your main objective should be learning, learning and learning only.
