here r some suggestions
- the PF act will apply to person drawing uotp salary of rs.6500
- they hv to covered from day one for which u don't hv any choice
- for others u can take policy decision to extend the said benefit to the employees whose salary exeeds 6500,
but u cannot
-- put restrictions like after one year
-- after probation
-- one single employee
u hv to do it to all the employees who are in that position. u can start now prospectively and not retrospectively( with some influence u can do it from that current year, ie PF year)
--instead ask them to pay public provident fund and reimburse the same to the employees, this can be extended when they serve one year or after confirmation, things like that.

HI Vikash, Madhu is correct, PF can be implemented for all the employee (old & new) unless the cealing limit of Rs.6500/- & no. of employees as per the law is considered. Regards, Sanjeev

as per my knowledge and understanding If an employee drawing Basic+ Da is more than rs. 6500/- per month and employer not interested to cover the employee in PF scheme, then employer has to obtain the fORM nO.11 . If employee is covered under the epf scheme by his previous employer then we can not deemed him as the exempt employee. Hence his PF is liable from the date of Joining subject to minimum contribution Rs.780/-(12 %) per month,
of the employee

As Mr Madhu has said it is possible for the existing employees also, there is limit of salary for coverage of an employee for your information the employee whose salary is more than Rs 6500/-PM subject to he has never been a member of PF fund or who has settled their account with PF department.
in present case the employee was getting more the coverage limit. Now by a resolution the company can extended PF benefit to all employees irrespective of salary before such resolution company should do proper home work that employee is a fresher & never been a member of PF. they can do so from the day onward but during inpection if found that such employee was earlier member of PF then contribution form the day of joining with interest need to deposit.

Earlier if you have taken concern from employee for not deducting PF as his Basic is more than Rs. 6500/- and now employee wish to start his PF Contribution then you can start from today.

As per the Provident Fund Act the employee's whose pay is less than Rs. 6,500/- per month is covered under the act. "Pay" includes basic wages, dearness allowance, retaining allowance and cash value of food concession. If an employee getting salary more than 6500/- he can become member of P.F. with the concent of the management. As management has to incurr 1.61% additional for admnistrative charges, etc.etc. However, if an employee is member of P.F. in his previous organisation and the organisation, he joins, falls under P.F. act. It is mendatory for the new organisation to deduct his p.f. This is what all i know.
