Strictly speaking as per law ,an employee can be terminated for misconduct without inquiry.Only problem in such cases is, the case will be open in the court if it reach that stage, The employee will have opportunity to adduce evidence in court just like in the domestic inquiry.The employer can defend the termination if it has concrete foolproof evidence.
