Sorry to say, how can a company terminate an employee on the ground of 1 day leave (not approved). What does your termination letter states. As per your querry it is termination due to excess leaves and you have accepted the termination letter which you indirectly admits.
Coming to your point if you do not have any excess leaves and continuity in your service then you can very well claim your gratuity as advised by other seniors

Dear pls read the procedure.
Employee, eligible for payment of gratuity, or any person authorized, in writing, to apply within thirty days from the date the gratuity became payable in Form ‘I’ to the Employer.
Employer within 15 days of the receipt of application, issue a notice in Form ‘L’ with details of amount & date of payment (not to exceed 13th day) or if Employee not eligible a notice in Form ‘M’ specifying the reasons why the claim for gratuity is not considered admissible.
If Employee is eligible, Employer to pay within 30 days, of the day on which it is due, irrespective of whether application received from Employee or not.

Dear Saji Sir,
I had taken leave dt. 20.01.2013 to 27.01.2013, but excess lease from 27.02.13 to 31.01.13 (5 days) was taken on telecon to HR. Company terminated my services and account settled but company neither given any written full & final nor a termination letter. Just said me you can not continue your services in the company.

I had never taken leave more than allowed by the company and no work break taken by me in last service period from Mar 4, 2007 to my last day in company (07.03.20013). i just taken casual leave and also never taken leave more than a week, which is allowed as per company. No notice or letter given by the company to me for excess leave in my whole service period. Our Company is Heavy Vehicle Company Situated in Haridwar , SIDCUL and more than 250 manpower working in the company. This is truth to the best of my knowledge.

If that is the case, then you approach the local Labor officer, who will take your employer on task, rest assured that if you have continuity in service then you are eligible for Gratuity, please do as Mr. Thejpal and other seniors has advised you.
