Gratuity elgibilty
Dear Sir,
I have completed 4 years and 10 months service in my present organization and i have accumlated leaves of 130.
Whether i am elglible for gratuity claim or not?
I have gon through the Gratuity law and it is saying that completion of 5 yrs only elgible for Gratuity with permited accident or death of employee with the exp. of 4 yrs and 240 days in 5th yr of service.
Please clarify.

The gratuity act has been ammended. The amount 3,50000 has been ammended to 10,00,000. Check Gazettte Notification.

I m doing job in shipping agencies, I m confused for my gratuity related question, My joining date was 1 june 2014 and i give resignation to my company for the one month notice period and my last date is 16 april 2019, so i am eligible for gratuity or not...? for the reference : i read so many comment and articles that for gratuity eligibility have complete 5 years but if you complete 4 year, 10 month and 11 days then also eligible for gratuity, and my company has 5 working days in a week,

I have left my private company with 4 years & 7 months & 15 Days with a last working day on 25th April 2016.
I was under impression that, there has to be 5 full years of continuous service, but it seems from the comments & other recent judgments, last 5th year can be considered even with less number of days.
Could you please clarify, if can claim for gratuity from my organization? What reference should I give alongside of my application?
I have 3 Post Retirement benefits in my CTC:
1. PF - 12% of basic salary
2. Superannucation- 15% of basic salary
3. Gratuity
As I mentioned earlier, I have left my organization, what the maximum I could claim? I am in the need of little extra finance if it is available as I have just started my new venture - start up.
