Dear Forum Members.
In our organisation we pay the Bonus to all the employee irrespective of Wages at the rates of 20% twice in a year i.e. every 6 months, one gross salary divided by 2. with the salary for the month of September by 30th Sep and in Mar with March Salary.
My query is it mandatory to file Bonus Annual Return under the Act with the Statutory Authority even though the Basic of all employees is more than Rs10,000.
If the Basic is less than Rs 10,000, but Gross amount exceed Rs 10,000 pm In such case filing of Annual Return is mandatory.

My answer to your query is "YES". It is mandatory to file annual return even though all employees are above Rs. 10000/- basic. However, the return should pertain to employees as defined under the Act. In your case you should file NIL return.
This is my view which is based on following:
The Act is applicable to (1) every factory & (2) every establishment in which 20 or more persons are employed.
Rule 5 says every employer shall sent a return in Form D....
The annual return is pertaining to bonus paid to employees. The term employee is as defined in section 2(13).
