Such a careless attitude is happening in workplaces day in and day out despite all stipulations, providing enough appliances and supervision. Keeping aside the legal angle, I wish to suggest on the humanity point of this. Of course, it appears to be negligence on the part of the workman and that of the supervisor. But humanity calls for sympathetic follow-up action. Please take all necessary steps to restore the vision loss or convalescence so that the injured can regain a working state of health, if not compensate for the loss in monetary terms. Judicial review can go either way depending on the evidence and witnesses, and therefore what is required now is benevolent remedial measures in preference to damage cover.
