Mr. Sahil,

Appreciate your response. Many companies try to evade payment of gratuity by various techniques, but being a social legislation, it will be viewed more broadminded and pro-employee. Legally, you are also on strong ground. Please approach the labour commissioner with your case, and I am sure gratuity will be released by the company.

I was working as a permanent employee for 12 years in a hospital. I submitted voluntary retirement and was relieved with all benefits, including Gratuity. After 2 years, i.e., from 2007, I was appointed in the same hospital as a full-time contract employee on a consolidated salary, which was renewed once every 2 years. In 2017, I ended my contract. Will I be eligible for Gratuity once again? If yes, what amount can I claim as Gratuity?
