Applicability of ESI is based on monthly wages; the Act is currently applicable to employees drawing a monthly salary of Rs. 15,000. All employees drawing more than this amount fall under the Employees' Compensation Act.

Employees engaged in 'uncovered' ESI areas will fall under the Employees' Compensation Act. The injury caused while going to and coming from duty is covered under the Employees' Compensation Act due to Supreme Court rulings. The ESI Act has been amended to cover these aspects. Please note this.

Somebody has mentioned that the Employees' Compensation Act is not applicable to managers; this is a totally wrong statement.
