hi rajan
the company is a big company in hyderabad and they are having a big legal muscle. So i am afraid of putting a legal fight against them.
Also the problem is that I dont have some letter like a termination letter
which the company has given me (as a proof that I was termed )
So instead of that the HR told me to give a resignation letter and in return gave a resignation acceptance letter.
And now they are demanding the bond amount saying that I had left the company and broken the bond
Thanks,
Samir

Dear Deepthi
From what you say like Family issues maybe the Management when the issue is placed before them in the proper perspective may re consider their stand. First make out a forceful appeal to them and then take specialist legal advice. We can help you locating a Counsel in your place .

Company cannot force a person to work for them, as such there is no just cause for them to retain the original certificates. A legal notice to return the certificates should normally work.
Regards the Bond, company shall have to prove that X amount was spent on specialist training or foreign trip etc. This involves filing of civil suit to enforce the bond and would take a few years to complete. As such, companies would be willing to settle with the employee ona fair basis without going to court.

Dear All,
I am new in this site and post my query in several place. therefore i am again putting my query, please revert with a good suggestion. Thanks in advance.
Hi,
I am working in Malaysia company in IT department in Malaysia. I signed two years bond with company the bond amount is if i terminate before 365 days than i will have to pay 6 months salary+Flight tickets + Visa fees+other exepenses incurred by company. If i terminate after 365 days but before 2 years than 3 months salary + all above. I came from india.
I already served 1 year and company has not given my bonus or any salary increment. Bonus is 10% of salary depends on performance. So company simply says that my performance is not up to the mark. Second thing i have family issues also, my MOther is not feeling well and i already submitted Medical certificate for this. BUt company is still demanding Bond money. I given them 3 months notice after discussion with my Manager and my manager ensured that he will waive off the money if i streamline the process ( Not in written) I did again hardwork and completed my tasks. NOw my manager is saying that it's depends on HR whether they want to waive off or not and simply change my department. Now he is not my manager and i heard he is leaving. The new HOD is also not cooperative. There were 6-7 employees who belongs to India and already left 4 employees as this company is treating very bad. They all ran away and nobody paid the bond. I could do also but i wanted peacefully leaving.
Can somebody guide me how to tackle this situation. I resigned in April and my last day in july but company is not ready to waive off my bond. Even they said my dependent visa will not renew as i am resigning before 2 years....
One more thing the bond clause is on Appointment letter not on any separate agreements.
Regards
Vicky

Hi Mr Rajan,
I also have a same concern, I had joined a big MNC in Sep'06 with a bond agreement to serve for the company for 3 years. The condition was like
- if leave before completion of 6 months - bond amt Rs 75K
-After 6months but before completion of 3 yrs -bond amt Rs 150K
I had resigned from the services in Mar'07 at the completion of six months ie before acceptance of next period letter.
Now in 2010 my present co. has come to know about the outstanding liability through background check report and want me to settle.
Q: Now in 2010, I request for relieving letter from my first employer but they are asking for 75k, shall I have to have pay the sum to get a relieving letter or there are any other way out as well??
