You must act as HR.Thats what you are making same tune of the employer.Employer would have asked you to
to stop PF benefits.You are HIS MASTER VOICE.As HR you have to explain the position to your boss.Even now you are asking about Form 11 to eliminate the employee from pf scheme.
This form 11 to be filled for new entrants those who are above Rs.6500/-.Even for this employees, you have to ascertain whether they were covered under EPF SCHEME in the previous unit.

just curious to know that.....if a company terminates all of its employees and hires them again, then PF deduction would be mandatory if the employees also opt of of PF contribution?? thanks in advance

Dear Mahalakshmi,
Sorry, once you in PF you have no option to quit or remove PF a/c. But, a fresh appointee who has no PF a/c in his life
and his PF wages is more than 6500/- He/she can keep out of PF by submitting Form II

Yes.PF is a mandatory.For trade purpose they are terminating again they are hired.It means
Employer is purposely doing this for avoiding pf.
There is no option of employees.According to act only to do

Once joined it is compulsory to pay even if he exceeds basic of Rs.6,500/- now there is a plan to remove the limit and every one has to pay.it s a measure of social welfare and every one has a right to enjoy that right

If employer is deducting and depositing EPF upon more than Rs 6500, he can reduce it to Rs 6500 later on and in that event section 12 of the EPF Act providing bar on reducing wages will not attract as was decided in MARATHWADA GRAMIN BANK KARAMCHARI SANGHATANA AND ANOTHER Vs MANAGEMENT OF MARATHWADA GRAMIN BANK AND OTHERS (SC 2011 LLR 1130)

Sir / Madam, What amount is to be deducted when the basic crosses Rs. 6500/- Is Rs. 780/- maximum or this amount can be increased? Pl. opine. Thanks, Vijay

Rs. 780 is ceiling amount for 6500 pm basic+DA or you can give 12% of actual basic as PF (3.67 % + Exceed amount of 541) and Pension (8.33 % or 541 whichever is less) + 1.61 Admin and EDLI charges on employer wish.

Dear Mahalaxmi,
You can stop PF contribution of Basic is more than Rs.6500/-. According to the law Employer can exempted.
But if you calculate CTC of Higher Salaried Person, PF is helpful to show bigger amount and employee is tie up with the company.
But on the other hand it is a big loss to employees.
I want to suggest one thing to all HR professionals, to write a letter to PF commissioner to increase the limit of PF contribution, which is in favours of employees. Because average minimum wages in India is Rs.5044/- for 26 days. and PF max. limit is Rs. 6500/-.
