In terms of para 26 of the P.F Scheme 1952 framed under P.F Act 1952, an employee is covered by P.F Act from the first day of his joining if his pay does not exceed Rs.6500/.p.m even though he is under probation.

Dear All,
In our factory, we are remitting the PF for our workers regularly. But few months before we were engaging some contract person for someother work. We did not remittence for the contract workers. When the E.O inspection, hr found that and he informed to Sub- Regional office. From Assistant Commissioner issued the notice to us to produce Balance Sheet, Ledger, Cashbook etc. In balance sheet what they would verified and what we should be hide anything pl........?

Sir,
I am working as a Manager - HR in an engineering company. I take chargs only four days in that company. My first task is to face the EPF hearing case. The AC of Sub- Regional Office gave a showcase notice to our management for not contributing the EPF for contract workers. They are demanding our Balance sheet, Ledger, Cashbook, Vouchers, attendance register, Pay roll register and all other related records to verify sir.
Can you anyone help me to how we can escape from these? Why they are verifying our Balance sheet, Ledger and Cashbook?

It is the responsibility of principle employer, to make sure contract employees statutory compliance is made in all respect.
This is given situation,you may always get back to statutory authority and ask for some more days time in writing.
Meanwhile you can check with your contractor if they have complied with statutory requirement,if not you can deduct the required amount from their monthly fees and remit the same towards statutory payment of contract employee and accordingly show the challan to statutory authority.

Mr.Saurav is right. In terms of Para (30) of the P.F Scheme 1952, the Principal Employer is liable in the first instance to pay the P.F contribution of contract workers. Under Sec.7-A of the P.F Act, the P.F authorities have the power to determine the amount of P.F that is due from your company and for that purpose they verify company's relevant records.

Thanks for your info and i wish to submit that I already gone thru the website and forwarded the contents to my superiors but they got a doubt that PF deduction will be done upto a saalry of Rs.6,500/- as usual but they are insisting me to show the relevant supporting Govt. circular / GO for the employees who are drawing salary above the amount. So Please suggest me.
