Notice for change in conditions of service
Hi All,

I am working as Deputy Manager in a Chemical factory in Punjab. The company have 3 more units in Haryana. Due to recession our company has shut down its operations from the last 3 months and decided to get transferred most of their employees with immediate effect in other units. Now recently the management has displayed the following notice : -

The following policy will be observed:

1.Those employees who opt for shifting to other units will be treated on deputation. Their salaries will be prepared at their earlier place of working and ESI & EPF deducted as on present. They will be paid traveling charges as per actual and back on completion of the deputation period.
Accommodation at transferred place as well as conveyance from place of stay to factory and back will be provided by company while expenses for meal will be borne by the employee .
2.Those who don’t want to shift will first avail of their due - leave, after exhausting their leave, they will be paid 30% of their CTC per month whose CTC is more than Rs. 7500/-and 40% of their CTC per month whose CTC is less than Rs. 7500/-

In my opinion as per Sec-9A of the ID Act the management should give 21 days prior notice to the employees.

Dear Jitender,

Notice for a change in conditions of service will come into picture only for those employees who are workmen under the ID Act, 1947. Before that, you should also refer to your standing orders. Again, standing orders are applicable to those who are covered under the Industrial Employment Standing Order Act, 1946. Please refer to the transfer policy of the organization also.
