The working hours on any day can not exceed 9 hours (again depending on which state as the shop and establishment act is separate for all states). This excludes lunch and break times. If you exclude break times, then even with 6 day working, you will probably not cross the 48 hours limit

As per the Karnatak Shops and Establishment act:

Daily and weekly hours:

1. No employee in any establishment shall be required or allowed to work for more than 9 hours on any day 48 hrs in any week.

Provided that the total number of hours of work including overtime shall not exceed 10 hrs in any day except on days of stock taking and preparation of accounts.

Provided further that the total number of overtime hours worked by an employee does not exceed 50 in a period of 3 continuous months.

2. No young person shall be allowed to work in any establishment for more than 5 hours in a day.

Extra Wges for Overtime:

1. Where an employee works in any establishment for more than 9 hours in any day or for more than 48 hrs in any week he shall in respect of overtime work be entitled to wages at twice the rate of normal wages.

2. For the purposes of this section "normal wages" means the basic wages plus such allowances, including the cash equivalent of the advantage accruing through the concessional sale to workers of foodgrains and other articles, as the worker is for the time being entitled to, but but does not include a bonus.

3. The cash equivalent of the advantage accruing through the concessional sale to a worker of foodgrains and other articles shall be computed as often as may be prescribed on the basis of the maximum quantity of foodgrains and other articles admissable to a standard family.

The periods of work of an employee in an establishment each day shall be so fixed that no period shall exceed five hours and that no such person shall work for more than 5 hours before he has had an interval of rest of atleast one hour.

Dear Seniors,
Please guide us for the necessary action to be taken in case of prolonged working hours of 9.30 per day with 2nd & 4th saturday's off.
Our company is engaged in supplying and providing Japanese engineering products.
Office timings are 9am to 6.30pm with 2nd & 4th Saturday off.
Though it is not acceptable to most of the employees no action is taken to change this situation.
Kindly suggest what steps to be taken to get the timings corrected and implemented as per law.

According to your statement your company is providing and supplying Japanese engineering products which means that your company is engaged in trading and therefore falls in the category of a commercial establishment under the Bombay Shop & Establishment Act, 1948, Section 14(1) of the Act prescribes that employees can work for nine hours in day and 48 hours in a week. However in Sub Section (2) it is provided that employees can work upto six hours in excess of 48 hours which means that a company can take work from the employees for a maximum of 54 hours in a week. Section 15 prescribes for one hour of rest after 5 hours of work. In your case you have not written any thing about the hours of rest that is given to employees. Therefore it is presumed that 9.30 hours of work includes the rest period of one hour. Therefore in your case I do not find any thing against the provisons of Section 14 and Section 15 of the Act. Please note that my answer is based on the information given in your question posted above. If you want to add any other information then you can disclose further to enable me to review my answer to satisfy your query. State Govt. or the local authority is the law enforcing agency under this ACT.

I am working in a small scale company which has around 25 members. Previously our office timings is 9am to 6pm. Now my company director ask me that if i am not percent 8 hours in the office, means if i percent 7:59 so he will deduct the half day salary and if we percent above 8 hours in the office he will not give me over time.
So please give us solution of this critical situation as per the Indian government Acts and also please mention the government acts
