Since the employee is covered under Mediclaim the entire hospitalisation amount will be taken care by the Insurance Company, as said by few of the members if the terms and condition of Insurance policy mentions the compensation alongwith the hospitalisation then the employer does not need to worry, even the salary will be paid by the Insurance Company. If the Insurance does not cover workmens compensation, there is no legal binding to pay the salary of 6 months, but on moral grounds the Company can pay or adjust his leave.

Unless the accident has occured during the course of employment and incidental to employment, the concerned employee cannot claim compensation under the Workmens Compensation Act.Moreover ,only workers are covered under the said Act.Further, all employees are not covered under the ESI Act.However, he will get medical facilities for his treatment as per your Mediclaim Policy/Group Insurance Policy. He can avail leave for the purpose of his treatment as per Rules of your Company.Further , on humanatorian grounds ,Management can deviate from the Rules with the approval of its Board of Directors as a special case.

Dear Tashn,
By the clause doctrine of notional extention you may give compensation to the concern employee . But you have to check that is that fellow always coming by the same route, thenyou may give benefit under "notional extention" . If the said fellow coming by the same route, then you may calculate the compensation as per disability as per employees compensation act, 1923.
Or if your company having accident insurance then ask the same .
Feel free to ask any query regarding the same.
