Dear All,
I would like to add one more aspect to this discussion.
If the staff is deployed through a labour contractor and is changed on frequent basis. The posting of staff is in the area where ESIC is not applicable but all staff has ESIC cards (issued from the main city-where ESIC is applicable) and get benefits in main city.
In such case, what shall the principal employer do. Whether they should pay ESIC or ask the labour contractor to get WC?

The esic act provides medical treatment facilities to the eligible employees. But the area which is not covered under esic can be covered uder employee compensation act. At the same time the employer can provide some other medical facilites like mediclaim insurance, personal accident insurance, group life insurance. In these insurance policy the premium should be paid by the employer and the employee will get the benefit from that policy.

Hi All,
As I said there are few benefit criteria has been changed as per Employee Compensation Act:
1. The compensation payable on death from the injury is
a.Minimum of 8000 Rs. increased to 12,000 rs.
b. 50% of monthly wages of deceased multiplied by relevant factor.
2. The compensation payable on Permanent disablement from the injury is
a. Min of 9000 rs increased to 14,000rs.
b.60% of monthly wages of deceased multiplied by relevant factor.
3. Revised Monthly wages ceiling limit of 50% of Rs 4000 increased to 50% of 8000 rs.
