Pls tell me if one have completed 4 yrs and 8 months in the same organization will it be considered as 5 years . Does this thing depends upon the organization to organization or it is universally acceptable and make legal ground as well.

Members have time & again submitted that strictly according to the Payment of Gratuity Act, 1972 an employee is not entitled to have gratuity from the employer but at the same time Hon'ble Madras HC have given the Judgement in the year 1996 which was reported in LLR as 1998 LLR 1072 which says that if the employee complete four years & 240 days in the fifth year as per this Act then that person is entitled to get gratuity from the employer.In this situation if the employer do not consider this Ruling then you can approach the Controlling Authority Under P G Act of your area by filing a claim case.

i had joined my pharmaceuticals company on 02.08.2010 and after completion of 05 years continuously they discontinued my services so i just wanted to confirm that am i eligible to claim gratuity.
When i joined my organization i was taken into the marketing department but in Oct 2013 i was shifted to Distribution and Logistics department. But there was no service break whatsoever.
There is no provision of DA ( Dearness Allowance) but getting CCA ( City compensatory Allowance). Can that ( CCA) will be taken into the account while calculating my gratuity amount.
You are kindly requested to help me to calculate my gratuity amount and which form i have to fill-up for claim my gratuity amount as my organization is not releasing the same.
My Gross Salary is 60500/- PM
My Basic Salary is 30250/- PM
My CCA is 6050 /- PM
Kindly help and guide me on the same.
