It is not understood, why organization fails to judge the performance of the employee during the probation period i.e. may be 30 days to any days as fixed. The most of the organizations explicitly uses of this clause of probation for the exploiting manner putting the life of people at stake because job market is volatile.

It is always a good thing to remove bad & unproductive people and to retain good & productive people. It is always a matter of appreciation when things are being done as per specified time. You have reached a decision as some of them will be kept under extended probation and others would be terminated from service since there are serious performance and behavior issues.
As per the terms your organisation, the candidates were not informed that the probation period has been extended further period X days, before being considered for absorption as a regular employee. And services can be even terminated even after the extended period of probation being not found satisfactory. Because the clause, your services can be terminated without assigning any reason with one month's notice or gross salary in lieu of notice on either side. Further, if not communicated at end of extended period of probation. Will it be deemed confirmation is a question? Dear friend space & time matters.

I can only advice you to take lenient view by asking the employee for their resignation to whom you want to terminate and pay them the notice pay.
You need to go by the opinion put forth by our senior members of the forum to which you think is best for your organisation.

hi could anyone of you learnet explain me that i have worked for more than 14 yres uninteruupted serive in a private college as assistant professor and recentely being promoted at senior level when i demanded appointment letter , i received a letter in which my past experrience with same college is not mentioned nor does it mentioned that you are promoted instead it is mentioned as per recommondation of commiteee you are appointed as professsor post for a probation period of one year .and to add more this appointmnet will be effective from the date of joining. because i need promotional apointment letter to be required for university guide purpose .
a joining letter prepared by college official mentioning one year probation period and onemonths notice will be applicable to both parties will be forced to sign me .
could this apporopiate or it would affect my continity of service and seniority and accordingly other beefits . please guide

The use of the term áppointed' is indeed a misnomer though many organisations are using such a term. The usage of the term appointment does not mean that it is fresh appointment since there is no termination of previous appointment. There is a term called 'Substantive Appointment' in Govt. organisations i.e. the confirmed post held by you before being selected as Professor. Now you are on probation, in case you are found unfit for being a Professor you will go back to your substantive post, i.e., the post on which you have a lien. On being found fit to be a Professor your substantive appointment too changes as Professor. So there is a continuity in your service from day 1 and your overall seniority is maintained. The seniority on the post of Professor will be from the day you assume the post.

These are the ways in which government organisation work in case your college has separate rules, it will have to be considered.
