Dear Ramesh,
We are into sales and marketing till date around 5 employees were drawing below 10000, so we did not bother about the ESI act. But after the revision around 21 employees come under this slab, so i have to do it right from the scratch, getting the code etc. If the number of employees falling under the slab becomes 17, is it mandattory for paying ESI, but our over all employee strength is 100 plus. Please confirm.

COVERAGE UNDER THE ESI ACT, 1948
The Act was originally applicable to non-seasonal factories using power and employing 20 or more persons; but it is now applicable to non-seasonal power using factories employing 10 or more persons and non-power using factories employing 20 or more persons.
Under Section 1(5) of the Act, the Scheme has been extended to shops, hotels, restaurants, cinemas including preview theatre, road motor transport undertakings and newspaper establishment employing 20 or more persons

Could you please through more light on post amendment changes.
As per your lines, irrespective of ceiling of pay do we required to cover all the employees under ESI preview. Please correct me if my understanding is wrong

As per ESI act , ESI coverage is applicable with aid of power 10 members and without aid of power 20 members those who are drawing ESI coverage limits. If your company is manufacturing company then ESI is applicable since employees is more than 10 members covering ESI limits. If your company other than manufacturing then ESI is not applicable since ESI Coverage employees is less than 20 members.

Check, whether your company area is covered under ESI. if not, need not cover.
if yes, you have to cover of those in preview of ESI w e f May 2010 irrespective of No.s since u have 120 employees on rolls

Dear Ramesh,
Can you please mail me the relevant part of the notification which states that the No. of employees irrespective of their salary levels are to be taken into consideration for purposes of ESI coverage.
It seems rather unlikely. For instance there are 100 employees in the org. All of them are drawing gross salaries of Rs.20000/- and above. What would be the relevance of obtaining a Code No. under ESI Scheme and find that the said Scheme is not applicable to any of the employees.

Hello Friends M workin as a Hr Executive in an It company, It Consists of nearly 15 people. Did IT have to dedect ESI from Employee’s salary..? Awaiting for your earlier Advice.....

Even i got the same doubt got clarification from my CA. The answers given by my CA :
If the company consists of 15 employees with the salary of 10k to 15k per month then there is no need to opt for ESI.
If the employees are more than ( excluding interns ) 17 its better to opt for ESI .
If we go for ESI then we have to do lot of administrative works for that and employee& employer have to pay some amount of money for the ESI.
I think its better to consult ESI authorities at your location.
