We are running Premises Society in Andheri , Mumbai area. Whenever Any office's being renovated or any furniture or any other goods are being delivered to any office, Mathadi kaamgaar Supervisor or any other mathadi worker stops them to load or unload in our premises in-spite of having their own workers for that work. Is Mathadi kamgar rules applies inside Premises Co-op. Societies in Mumbai? Please guide us.

Dear all,
As per Maharashtra Mathadi Hamal and other manual workers (Regulation of Employment and Welfare) Act, 1969, all loading unloading acitivities carried out in the scheduled employments listed in schedule which includes employment in factories has to be done by the headload workers or mathadis who are registered with the Mathadi Board of relevant area such as Mumbai, Thane etc where the factory is located. If the employer has engaged contractual workers for this work they have to seek exemption from the Board for them. All labour laws are applicable to the mathadi workers and the employer has to pay the salary alongwith cess to the Mathadi board every month if the registered Mathadi workmen are engaged. Employment in markets and factories and other establishments in connection with loading, unloading, stacking, carrying, weighing(measuring, filing, stitching, sorting, cleaning or such other work) including work prepratory or incidental to such operations carried on by workers not covered by any other entries in the Schedule

We have engaged couple of years back “Mathadi Gang/ Tolis” affiliated with Maharashtra Mathadi Board” in Mumbai for loading / unloading work of construction materials@ Construction Project site
Now the management wants to terminate the said existing Mathadi Gang/Tolis and appoint some other Mathadi Gang/ Tolis.
Request to HR fraternity, please enlighten us the steps / process / procedures to be taken to terminate the existing Mathadi Gang/ Tolis @ construction site.
Substance : We have mobilized some contract workers from other projects / construction sites site for loading and unloading work of construction materials , due to completion of that particular project.
