Dear Seniors,
So the final word is 'its not legal to reduce the salary depending upon the work timings'..Whatever amount we are paying for 8 hours work we should be pay for 6 hours also...!!!!!
Am i correct??

Hi,
I think we shouldn'g go merely on arithmatic in the matter. Fixing a wage pattern is all the more albeit difficult giving a suitable the designation itself. Logically parttime remuneration should have been based on the broad classifications in vogue such as - Tech. > unskilled, semi skilled, skilled, highly skilled. Non-Tech. also may be on the same lines. We know we are employing Engineers, Doctors, nurses, Acctts, CAs., lawyers, HR experts on part time basis ( we mayn't call them as part time but consultants to give a decent designation). I think all cannot be fitted on the minimum wages scale.
Safely unskilled, semi skilled, skilled can be used for this discussion ?
The queriest has not given the query with such indications. In the absence of some lead generally offering some opinion is rather unfair.
And we shouldn't forget even parttime workers are also entitled for PF.
Are we on the right track ?

this is my opinion, if you are taking work according like 6 hours for some day that is applicable. but you are taking work according 6 hours full month than you will pay according 8 hours.

Dear Swetha,
The word and term minimum applies to the amount of wages to a work for the duration of 8 hours or part thereof. This is the law and if you intreprete in your own way without application of mind and correct understanding you are answerable to the State authorities and of course your management if the question you at a later stage. Again and again I have informing all the time, please refer to the rule book if you want the application of the rules .As a matter of fact if you are in HR department -- whichever role you play-- you should keep the relevant ready reckoner and latest books and publications of State Govt on Factories Act, Minimum Wages and Gazette.

hi the questions seems to be very interesting but the amount of money you are asking is very less and the minimum wage working for 6 hours should not be less than 6000 per month.

May be you may find some clue from this -
1. Instead of struggling with working hours and minimum wages etc. why don't you consider fixing a lump sum remuneration for piece work on daily basis payable thro' monthly payment, if you don't have any problem in carrying them on your rolls ?
Labour contract mode:
2. Alternatively employ them through the contractor of HK etc giving a detailed work description and paying them thro' monthly bills. Still they will be governed by CLRA Act. where you have to ensure PF, ESI etc.
Works contract mode:
3. Also you can finalise an AMC without involving any supervision by you for which the annual lump sum payment is released on monthly basis either proportinately or as advances.
Any other suggestions dear friends ?

one thing minimum wages cant b splitup
there shd be 3 categories.Skilled,semiskilled,unskilled.
minimum wages are for 8 hrs.we should pay that amount.
and one more thing ,minimum wages are classified based on different industries.

Before I suggest anything you should be clear that there is no such thing as "PART TIME JOBS" in Minimum Wages Act. Now either the person is employee or not (as legal point of view).

Assuming the "Part Timer" as employee then there are two conditions to this:

1 : if a person is employed but not working a full normal day then the following Sec 15 of Minimum wages Act would apply.

Wages of worker who works for less than normal working day.



15. Wages of worker who works for less than normal working day.-

If an employee whose minimum rate of wages has been fixed under this

Act by the day works on any day on which he was employed for a period

less than the requisite number of hours constituting a normal working

day, he shall, save as otherwise hereinafter provided, be entitled to

receive wages in respect of work done by him on that day as if he had

worked for a full normal working day:



Provided, however, that he shall not be entitled to receive wages

for a full normal working day--

(i) in any case where his failure to work is caused by his

unwillingness to work and not by the omission of the

employer to provide him with work, and

(ii) in such other cases and circumstances as may be

prescribed.

Now the Second Condition:

2 :

Sec17. Minimum time rate wages for piece work.- Where an employee is

employed on piece work for which minimum time rate and not a minimum

piece rate has been fixed under this Act, the employer shall pay to

such employee wages at not less than the minimum time rate.

(Above is regarding to law)

( IMPORTANT: Now to your question, if the specific government specify minimum time rate then you can pay "Part Timer" as hourly rate but if not specified then go with options)

May I suggest : are you giving (if you r the employer) rest intervals in those 6 hours?
